General Terms and Conditions – TRYPLO
1. Who are we?
TRYPLO specializes in supplying personalized photo products. We are located in Heerlen and registered with the Chamber of Commerce under number 14095530. Our VAT identification number is 818202567B01.
These terms and conditions apply to all our services, products and communications through our website, mobile applications or other channels.
2. When do these terms and conditions apply?
Once you use our services, create an account or place an order, you automatically agree to these terms and conditions. We recommend that you read them carefully. You can view them at any time on our website or receive them in PDF format upon request.
3. Establishment of an order
An agreement between you and TRYPLO is established as soon as we have received your payment and your design has been successfully uploaded. You will receive a confirmation of this by e-mail.
Please note: Personalized products are made especially for you and cannot be cancelled once production has started.
4. Production time and delivery
Once your order is fully completed and paid for, we will start the production process as soon as possible. The expected delivery time is listed when you complete your order. Please note that holidays, busy periods or unforeseen circumstances may affect this delivery time.
5. Prices
The prices listed on our website, in our emails and marketing materials are for informational purposes only and may vary from time to time depending on factors such as availability of materials, selection options and ongoing promotions.
5.2. VAT and Additional Costs
All prices include VAT, where applicable. Prices do not include shipping costs, import duties, levies and other taxes that may apply.
5.3. Payment and Shipping Costs
The final price of your order, including shipping costs, will be displayed during the ordering process and is part of our offer. You agree to this price by completing payment, the final step of the ordering process.
For deliveries outside the Netherlands, shipping costs do not include additional costs such as customs duties, import taxes and other charges. These costs are calculated by the customs of the destination country, and we cannot provide you with specific information on these. We recommend contacting your local customs office to find out if these charges apply to your order. This does not apply to orders within the Netherlands.
5.4. Discounts and Promotions
In the case of discount codes and promotions, each discount is subject to specific conditions. If a discount code is no longer valid, the standard price for the products in question will apply.
5.5. Payment Methods and Confirmation
Our websites and apps provide information about the various payment methods available. You place an order by completing your payment during the ordering process. Once we have received your payment, your order is registered and the contract is established, subject to the successful uploading of your photos. Upon receipt of payment, we will send you a confirmation email.
6. Your responsibilities
- You are responsible for the use of images and text that you provide. You declare that you own the legal rights for this, including copyright and portrait rights.
- It is not permitted to use images that are illegal, offensive, discriminatory or otherwise inappropriate.
- Our products are intended for personal use only. Commercial use is permitted only with the written permission of TRYPLO.
- You may not use our website or software for harmful activities such as spreading viruses or spam.
- If by your use you cause damage to TRYPLO or third parties, you are fully liable for it.
7. Liability
TRYPLO makes every effort to provide high-quality products. If anything does go wrong, please contact us through our customer service.
Our liability is always limited to the amount you paid for the order in question. We are not liable for indirect damages such as lost profits or consequential damages, unless there is intent or gross negligence on our part.
8. Intellectual property
All rights to our software, designs, text, logos and other content on our platforms belong to TRYPLO or our partners. You only get the right to use our services as described, and you may not copy, distribute or edit our content without permission.
9. Privacy & data processing
We handle your personal data with care and adhere to applicable privacy laws (AVG).
9.1. What data do we process?
We process only the data necessary to create and deliver your Tryplo product, such as:
- Your name and contact information
- The photo(s) you provided.
- Any additional information for personalization
9.2. How long do we keep your photos?
Your photos are kept for a maximum of 30 days after delivery of the product, unless you give us prior permission to use them longer (for example, for portfolio or reprints).
9.3. Who do we share your photos with?
We do not share your data with third parties, except with production partners necessary for printing and mailing your Tryplo. These parties are bound by strict privacy terms.
9.4. Your rights
You always have the right to inspect, correct or delete your data. Please send us a message about this at contact@tryplo.nl.
10. Retention periods
– Projects you create but do not order are automatically deleted after 18 months.
– If you do not use an account for an extended period of time (e.g., 18 months), we may delete your projects.
– Invoice information we keep by law for up to 5 years.
11. Force Majeure
If we are temporarily unable to deliver due to circumstances beyond our control, such as power outages, natural disasters, pandemics or governmental measures, this is considered force majeure. In that case, we may suspend our obligations or dissolve the agreement.
12. Changes to these terms
We reserve the right to modify these terms and conditions. Important changes will be announced in advance via email or on our website. If you continue to use our services after a change, you agree to the modified terms.
13. Applicable law and disputes.
These terms and conditions are exclusively governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam. You can also use the European ODR platform(https://ec.europa.eu/consumers/odr) for online dispute resolution.
